Did You Know?

Some owners were unable to protect their marks.
Some owners were unable to protect their marks after the public adopted them as common product names: corn flakes, dry ice, aspirin, escalator, high octane, kerosene, lanolin, linoleum, mimeograph, nylon, raisin bran, yo-yo, shredded wheat.

Sellers of goods throughout the ages have put their names on things they produced. Some producers devised symbols or pictures to identify and distinguish their products. Before the 20th century, trademarks were usually symbols or pictures rather than words. Under the common law in each state, a seller who uses any symbol as a trademark acquires the legal right to prevent other sellers from using a similar mark. Many sellers federally register their trademarks for extra protection.
